General terms and conditions
1. OBJET
These general terms and conditions of sale are entered into between, on the one hand, FAZEBRA EIRL, whose registered office is located at 220, Allée des Figons, 13510 EGUILLES, registered with the AIX-EN-PROVENCE Trade and Companies Register under SIREN number 850 329 954. Hereinafter referred to as "the Company," and any natural person making a purchase (hereinafter referred to as "the Customer") on the website fazebra.com (hereinafter referred to as "the Site").
These terms and conditions govern the sale of all products presented on the Site. The Company reserves the right to adapt or modify these terms and conditions at any time. In the event of modification, the terms and conditions in effect on the date of the order will apply to each order. If a condition is missing, it will be considered governed by current practices in the distance selling sector, in accordance with the law. French law, which shall be the sole applicable law.
The Customer must be:
- either a natural person over the age of 18 and with full legal capacity to enter into a contract;
- or an emancipated natural person under the age of 18;
2. MARKETED PRODUCTS
The Customer may select one or more products from the different categories offered on the Website. It is specified that the Company may modify the assortment of products offered on the Website at any time, without prejudice to orders placed by the Customer.
As these are handmade creations, certain elements such as the lining, zipper, rivets, or other small details may differ slightly from those presented on the Website. In the event of significant differences, the customer will be contacted and their approval will be requested before the order is shipped.
3. AVAILABILITY AND PRICES
Product and price offers are valid as long as they are visible on the Website. In the event of promotional offers, the prices indicated will be valid for the duration of the offer, on a selection of products.
When processing their order, the Customer will be informed as soon as possible by email if the ordered products are unavailable. These products will not be invoiced to the Customer.
The articles of association of FAZEBRA EIRL stipulate that the company is not subject to VAT. VAT not applicable, Article 293B of the French General Tax Code (CGI).
The Company reserves the right to modify its prices at any time but undertakes to apply the rates in effect at the time the Customer's order is placed, subject to product availability on that date.
The products remain the property of the Company until full payment of the price by the Customer. However, the risks will be transferred to the Customer upon receipt of the product(s) by the Customer.
4. ORDERS
Product availability and delivery times are displayed on the Website. Any order placed on the Website implies express and unreserved acceptance of these General Terms and Conditions of Sale, although this acceptance is not conditional upon the Customer's handwritten signature.
All orders require the creation of a customer account. Once the account is created, the Customer will have access to their customer area. Access to this customer area is subject to Customer identification using the email address provided when creating the account and the secret and personal password chosen. The Company shall not be held liable for any actions taken in the customer area by a third party to whom the Customer has communicated their login details or who has gained access to the account due to the Customer's negligence. All information relating to the order will be available in the "Order Tracking" section of the customer area.
The Customer undertakes to ensure that the information provided when placing the order is complete, accurate, and up-to-date. Failing this, the Company reserves the right to cancel the order outright.
It is important to verify that you have entered your first and last name, full address, email address, and telephone number correctly. Orders received without the above information or with incorrect information cannot be shipped.
The order can be placed for a delivery address separate from the billing address. Orders become binding upon the Customer as soon as they confirm their payment by clicking "Confirm".
Upon receipt of the order, the Company will send the Customer an order confirmation email including the order summary and order number, and will then definitively validate the order by sending an order confirmation email. These emails will be sent to the email address provided when creating the customer account.
The Company reserves the right to refuse or cancel an order if it believes that the Customer is engaged in distribution or economic activity through the products ordered, or for any other reason.
5. MODIFICATION OF THE ORDER
Any request to modify an order placed will only be considered by the Company if it has been submitted to Customer Service: contact@fazebra.com or, more quickly, via WhatsApp: +33 7 87410476.
6. COMPLAINTS
Any complaint regarding the receipt of the order (damaged product, etc.) must be submitted to Customer Service: contact@fazebra.com before the end of the withdrawal period, fifteen (15) days following receipt of the order.
After this period, complaints will not be considered by the Company, except for those relating to the guarantees as defined in Article 11 below.
7. RIGHT OF WITHDRAWAL
The Customer has fifteen (15) clear days from receipt of their order to notify the Company of their intention to return any product that is not suitable. When the withdrawal period expires on a Saturday, Sunday, or public holiday, it is extended until the next business day.

Customer Service will acknowledge receipt of the Customer's request and inform them of the return procedure for the product(s).
The Customer will have 30 days following notification of withdrawal to return their product(s).
Products excluded from the right of withdrawal:
In accordance with the provisions of Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the Customer's specifications or clearly personalized. Only unused products returned complete, with their labels, instructions, warranties, cords, and other accessories in perfect condition and in their original packaging, ready for sale, will be accepted.
Return costs:
If the Customer exercises their right of withdrawal, the cost of returning the product(s) is the responsibility of the Customer.
The Company does not accept packages sent freight collect or cash on delivery.
Refund following withdrawal:
In accordance with the French Consumer Code, the Company is required to refund all amounts paid, including one-way shipping costs (at the standard rate). The refund will be made upon receipt of the returned product(s). The Company will refund the product(s) using the same payment method used for the order or in any other form with the Customer's express consent.
8. RETURN
In addition to the right of withdrawal, the product may be returned in the event of non-compliance with the order (incorrect reference number or damaged product) or a defect (see Article 11 – Warranty).
If the Customer receives a reference number other than the one ordered, or a damaged or defective product, they are invited to contact the Company's Customer Service (Article 15). In this case, the non-compliant or damaged product must be returned to the Company, and the Company will, at the Customer's discretion, offer to either replace the ordered reference number or refund the full amount of the order (order price + any shipping costs paid) using the same payment method used when ordering upon receipt of the non-compliant or damaged product.
The Company will inform the Customer of the product return procedure and will cover the shipping costs.
9. PAYMENT OF THE PRICE
Payment is made online at the time of ordering and will be collected by the Company immediately before the order is prepared.
Payment Methods
The following payment methods are available to the Customer:
- Bank card: Carte Bleue, Visa, MasterCard
Discount codes: Discount codes issued by Customer Service may be used when purchasing on the Website to pay for all or part of the order. These discount codes can only be used once.
Secured Payments:
Payments made on the Website are completely secure.
Thanks to the technical features of the encryption software used on the Website, the bank details (bank card number and expiration date) provided by the Customer cannot be intercepted by third parties. By providing their bank details, the Customer agrees in advance and unconditionally that the Company may proceed with the secure transaction. The Customer therefore authorizes their bank in advance to debit their account based on the statements sent by the Company, even in the absence of invoices signed by the cardholder. Authorization to debit the Customer's account is always given for the amount of the product purchased as invoiced by the Company.
For security reasons, if the Customer wishes to link their payment card to a new delivery address, they must re-enter their payment card number in full.
The Customer has the right to save their payment card information, subject to their express consent.
The occurrence of an unpaid amount due to fraudulent use of a bank card will result in the registration of the details relating to the order associated with the unpaid amount in a payment incident file set up by the Company. Irregular declarations or anomalies may also be subject to specific processing.
In accordance with the French Data Protection Act and European regulations concerning the protection of personal data, you have the right to access, rectify, object to, and delete your personal data. 10. SHIPPPING
The delivery times stated on the Website are calculated in business days. The delivery date is calculated taking into account the order delivery time, plus the carrier's delivery time.
The delivery time begins when the package leaves the Company's warehouse; it is therefore added to the order shipping time. The Customer is notified by email as soon as their order is shipped.
The delivery time depends on the delivery method chosen when placing the order.
Products are delivered to the designated parcel relay point or to the delivery address specified when ordering, depending on the Customer's choice.
In the event of an exceptional stock shortage, the Customer will be notified by email or telephone. The Company will offer the Customer either to delay delivery of the entire order until the product in question is restocked, or to accept partial delivery with a refund of the purchase price of the undelivered product(s), or to cancel and refund the entire order.
11. LEGAL GARANTEE
Article L 217-4 of the French Consumer Code:
The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery.
The seller is also liable for any lack of conformity resulting from packaging, assembly instructions, or installation when the seller is responsible for the contract or is responsible for the installation.
Article L217-5 of the French Consumer Code:
The good conforms to the contract:
1/ If it is suitable for the use normally expected of a similar good and, where applicable:
- if it corresponds to the description given by the seller and possesses the qualities that the latter presented to the buyer in the form of a sample or model,
- if it possesses the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling,
2/ Or if it possesses the characteristics mutually agreed upon by the parties or is suitable for any special use sought by the buyer, made known to the seller and accepted by the latter.
Article L 217-12 of the French Consumer Code:
Action resulting from a lack of conformity is time-barred after two (2) years from delivery of the good. Article L 217-7 of the French Consumer Code:
Lack of conformity appearing within twenty-four (24) months of delivery of the goods is presumed to have existed at the time of delivery unless proven otherwise.
The seller may challenge this presumption if it is inconsistent with the nature of the goods or the alleged lack of conformity.
The legal warranty against hidden defects
Article 1641 of the French Civil Code:
The seller is bound by the warranty for hidden defects in the item sold that render it unfit for its intended use or that so diminish this use that the buyer would not have acquired it or paid a lower price if they had been aware of them.
Article 1648, paragraph 1 of the French Civil Code:
The action resulting from hidden defects must be brought by the buyer within two (2) years of discovering the defect.

13. INTELLECTUAL PROPERTY
The entire Site and each of its elements are subject to intellectual property legislation, including copyright, designs, trademarks, domain names, software, databases, etc. (without this list being exhaustive).
As such, all rights of reproduction, representation, and public communication are reserved, including for downloadable documents and visual, photographic, audiovisual, or other representations. Customers are granted the sole right to view the Site. Reproduction of all or part of the content is authorized solely for informational purposes and for personal and private use.
Any link to the Site must be authorized in advance in writing by the Company. The Company declines all responsibility for the content of these links. In any event, hyperlinks to the Site must be removed at the Company's first request.
14. LIABILITY
The Company shall not be held liable, and no compensation may be claimed, for delivery delays or harmful consequences due to force majeure as defined by the case law of French courts and tribunals.
The Company shall not be held liable for interruptions, delays, or unavailability of the Site due to maintenance work, internet network interruptions, technical failures, force majeure, the actions of a third party, or any other circumstances whatsoever.
The Company strives to ensure, to the best of its ability, the accuracy and updating of the information published on the Site, which it reserves the right to correct at any time and without notice.
The Site contains information from third parties; therefore, the Company makes no guarantees as to the accuracy, precision, or completeness of the information made available on the Site. The Company cannot be held responsible for any occasional errors that may occur on the Site.

12. APPLICABLE LAW
These General Conditions of Sale are subject to French law.
